Terms and Conditions of Sale
These terms and conditions of sale govern the use of services offered by Mirai-Tech SAS, publisher of the 22Calendar service.
Article 1 - Purpose
These Terms define the rights and obligations of the parties in the context of subscribing to 22Calendar services, an AI-powered appointment scheduling and lead qualification platform.
Article 2 - Services Offered
22Calendar offers the following services:
- Custom qualification flow creation
- AI assistant for lead pre-qualification
- Calendar synchronization (Google, Outlook, etc.)
- Intelligent routing to multiple calendars
- Third-party tool integrations (CRM, video conferencing, etc.)
- Analytics and dashboard
Article 3 - Pricing and Payment
3.1 Plans
Current pricing is available on the Pricing page. 22Calendar offers a free plan and paid plans (Pro, Business).
3.2 Billing
Paid subscriptions are billed monthly or annually based on the customer's choice. Billing is charged in advance.
3.3 Payment Methods
Payment is made by credit card through our secure payment processor Stripe.
3.4 Price Changes
22Calendar reserves the right to modify its pricing. Customers will be notified 30 days before new pricing takes effect.
Article 4 - Duration and Termination
4.1 Duration
The subscription is entered into for an indefinite period (monthly) or a fixed period (annual) depending on the chosen plan.
4.2 Termination by the Customer
The customer may cancel their subscription at any time from their account dashboard. Cancellation takes effect at the end of the current billing period. No pro-rata refund shall be issued.
4.3 Termination by 22Calendar
22Calendar may terminate the subscription in the event of a breach of these Terms, following a formal notice that has remained without effect for 15 days.
Article 5 - Customer Obligations
The customer agrees to:
• Provide accurate information upon registration
• Use the service in accordance with its intended purpose
• Not use the service for unlawful or abusive purposes
• Protect their login credentials
• Respect third-party rights and applicable regulations
Article 6 - Liability
6.1 Availability
22Calendar endeavors to ensure maximum service availability but does not guarantee 100% uptime. Scheduled maintenance operations will be communicated in advance when possible.
6.2 Limitation of Liability
22Calendar's liability is limited to direct and foreseeable damages, up to the amount paid by the customer during the preceding 12 months.
6.3 Force Majeure
22Calendar shall not be held liable in the event of force majeure as defined by Article 1218 of the French Civil Code.
Article 7 - Intellectual Property
22Calendar retains all intellectual property rights over the service, its interface, algorithms, and documentation. The customer is granted a non-exclusive right of use for the duration of their subscription.
Article 8 - Data Protection
The processing of personal data is governed by our Privacy Policy. 22Calendar acts as a data processor within the meaning of the GDPR for the customer's prospect data.
Article 9 - Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts providing digital content not supplied on a tangible medium, the performance of which has begun with the consumer's prior consent.
Article 10 - Governing Law and Disputes
These Terms are governed by French law. In the event of a dispute, the parties shall endeavor to reach an amicable settlement. Failing that, the competent courts shall be those of the registered office of Mirai-Tech SAS.
Article 11 - Amendment of Terms
22Calendar reserves the right to amend these Terms. Customers will be notified by email 30 days before any amendments take effect. Continued use of the service constitutes acceptance of the updated Terms.
